Terms of Service

Please read these Terms of Service ("Terms") carefully before downloading, installing, registering, or using the NimoteCode mobile application (the "App" or "Service") provided by NimoteCode ("we", "us", "our", or "the Company").

These Terms form a legally binding agreement between you and the Company. By accessing or using the Service in any way, you agree to be bound by these Terms. If you do not agree, you must not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. By using the App, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2. Account and Security

• You are responsible for creating and maintaining accurate account information via Firebase Authentication.
• You must keep your login credentials confidential and not share your account.
• You are fully responsible for all activities under your account.
• Notify us immediately of any unauthorized use at aoun.ma@foxmail.com.

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App solely for your personal and/or professional software development purposes on supported devices.

4. Free and Paid Features

• Free Tier: Includes core features such as single SSH session, SFTP file management, syntax highlighting, terminal support, basic AI assistance (user-configured models), GitHub repository browsing, adaptive UI, and themes.
• Paid Subscriptions: Unlock advanced features including multiple concurrent SSH sessions, global/symbol search, Git visualization (status, history, blame, line-level tracking), code outline navigation, and priority support. Subscriptions are managed via RevenueCat in conjunction with Apple App Store or Google Play.
• Subscriptions are auto-renewing and managed exclusively through Apple App Store or Google Play.
• Pricing, features, and trial periods may change with notice.

5. User Conduct and Restrictions

You agree not to:

• Use the Service to access any system, network, or data without proper authorization.
• Attempt to reverse-engineer, decompile, disassemble, or extract source code from the App.
• Introduce viruses, malware, or harmful code.
• Interfere with the Service's operation or other users.
• Use the Service for illegal purposes or in violation of third-party rights.
• Circumvent subscription restrictions or payment mechanisms.

6. Remote Access, SSH/SFTP, and AI Features

• All SSH/SFTP connections are established directly from your device to the remote server using credentials you provide and store locally. We do not act as a proxy, intermediary, or host for your connections.
• We do not access, log, store, or have visibility into commands executed, files transferred, or code edited on remote servers.
• AI assistance requires you to configure external models/APIs (third-party or local). All interactions (prompts, code context, responses) occur directly between your device and the chosen AI provider. We do not receive, store, or process this data.
• You are solely responsible for securing your remote servers, complying with third-party AI provider terms, and ensuring you have authorization to access any systems.

7. Intellectual Property

The App (including code, design, graphics, trademarks, Tree-sitter integrations, Rust backend components, and Flutter UI) is owned by us or our licensors. You receive no ownership rights beyond the limited license above. GitHub browsing respects repository owners' rights — you may not misuse or redistribute content without permission.

8. Payments, Subscriptions, and Refunds

• All purchases and subscriptions are final and non-refundable except as required by law or platform policy (e.g., Apple/Google refund windows).
• Subscriptions auto-renew until canceled at least 24 hours before the renewal date, managed via RevenueCat.
• We may offer promotional trials — standard Terms apply during trials.
• Pricing changes will be notified in advance.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, SECURE, UNINTERRUPTED, OR THAT DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Termination

We may suspend or terminate your access at any time for violation of these Terms, non-payment, or any other reason, with or without notice.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of [Singapore / State of California / your chosen jurisdiction], excluding conflict of laws rules.
Any disputes shall be resolved exclusively through binding arbitration in [location] under [e.g., Singapore International Arbitration Centre / AAA] rules, or in courts of [location] if arbitration is unenforceable.

13. Changes to Terms

We may modify these Terms. We will provide notice of material changes (in-app, email, or App Store). Continued use constitutes acceptance.

14. Miscellaneous

• Entire Agreement: These Terms (plus Privacy Policy) constitute the full agreement.
• Severability: Invalid provisions do not affect the remainder.
• No Waiver: Failure to enforce does not waive rights.
• Assignment: We may assign these Terms; you may not without consent.
